End-User License Agreement (EULA) of Digital Planner
1. Agreement
This End User License Agreement (‘EULA’) is a legal agreement between you and Alina Shpak, Individual Entrepreneur, Ukraine, governing your use of Digital Planner for iPad (‘Digital Planner’ or the ‘App’), a planning application designed primarily for iPad and also available on iPhone and Mac as compatible companion experiences.
2. License Grant
The application is licensed, not sold. Subject to compliance with this EULA, you are granted a limited, non-exclusive, non-transferable, revocable license to use the application on Apple-branded devices.
3. Scope of License
You may use the application solely for personal, educational, and business planning purposes in accordance with applicable laws and Apple’s terms.
4. Subscription Features
Certain premium features require an active subscription purchased through Apple In‑App Purchases. Subscription management and entitlement verification may be provided through RevenueCat.
5. Cloud Services
Synchronization, backup, cross-device access, and collaboration features may rely on Apple iCloud, CloudKit, and CloudKit Sharing services, including supported synchronization of User Content between compatible iPad, iPhone, and Mac devices. Calendar events and reminders may also be synchronized through supported Apple or third-party services as described in this EULA. Availability depends on the applicable service infrastructure.
6. User Content
You retain ownership of content you create or manage through the application, including planner content, calendar entries, tasks, and reminders. You are solely responsible for the content you create, upload, store, synchronize, export, import, share, or manage through the application.
7. Shared Content
When using collaboration features, you are responsible for granting access to collaborators and understanding that shared content may be visible to invited participants.
8. Apple Reminders
With your permission, the application may request Full Access to Apple Reminders through Apple EventKit to read, create, edit, delete, complete, and synchronize reminders and reminder lists.
Synchronization may operate in both directions between Digital Planner and Apple Reminders.
Reminder content is processed through Apple services and your device and is not stored on Company-controlled servers.
9. Calendar Integrations
With your permission, the application may connect to Apple Calendar, Google Calendar, and Microsoft Outlook to display and synchronize supported calendar information. For Google Calendar and Microsoft Outlook, the application may use the applicable sign-in, API, and authorization services to read calendar information and to create or edit supported event data when you request those actions, including event titles, dates, times, locations, and descriptions. Supported changes made through Digital Planner may be synchronized back to the connected calendar service. You are responsible for granting and managing access to your calendar accounts and may revoke access through the applicable device, Google, Microsoft, or application settings. Availability and operation of these integrations depend on the respective third-party providers.
10. Third‑Party Services
The application may integrate services provided by Apple, including iCloud, CloudKit, Apple Calendar, Apple Reminders / EventKit, and related services available on iOS, iPadOS, and macOS; Google Calendar, Google Sign-In, and Google API services; Microsoft Outlook and Microsoft authentication/API services; RevenueCat; Firebase Analytics; Firebase Crashlytics; AppsFlyer; Amplitude; Facebook App Events; HubSpot; and related providers. Third-party services are subject to their own terms, privacy practices, availability, and technical requirements. The Company does not control and is not responsible for outages, changes, restrictions, or other acts or omissions of those third-party services. Availability of specific integrations and SDKs may vary by platform and app version.
11. Restrictions
You may not reverse engineer, decompile, modify, distribute, sublicense, rent, lease, sell, exploit, or create derivative works based on the application except as permitted by law.
12. Updates and Modifications
The company may release updates, modifications, bug fixes, enhancements, or new versions at its discretion.
13. Privacy
Collection and processing of information are governed by the Privacy Policy available on digitalplanner.biz.
14. Support
Support may be provided through support@digitalplanner.biz and related support channels. No obligation exists to provide ongoing support.
15. Disclaimer of Warranty
The application is provided on an ‘AS IS’ and ‘AS AVAILABLE’ basis without warranties of any kind except where required by law.
16. Limitation of Liability
To the fullest extent permitted by law, Alina Shpak shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages.
17. Termination
This EULA terminates automatically if you fail to comply with its terms. Upon termination, you must cease all use of the application.
18. Export Compliance
You agree to comply with all applicable export control and sanctions laws.
19. Governing Law
This EULA shall be governed by applicable laws without regard to conflict of law provisions.
20. Entire Agreement
This EULA, together with the Privacy Policy and Terms of Use, constitutes the entire agreement between you and the company regarding the application.
